These general terms and conditions apply to any reservation made for a trip aboard the Malaïka Odyssey (abbreviated MO). In this context, MO refers to our local company, PT Malaïka Indo Odyssey (abbreviated PT.MIO), as well as our vessel, the Malaïka Odyssey. The terms “we,” “our,” and “us” refer to MO, its staff, agents, representatives, and all affiliated entities involved in organizing the trips.
The term “Client” refers to any person who has booked a trip, as well as any other person traveling with them as part of this reservation. The term “Commencement” refers to the Client’s scheduled arrival date aboard the Malaïka, marking the start of the trip.
The prices displayed on our website are based on costs and exchange rates in effect at the time of publication. We reserve the right to modify prices at any time based on economic fluctuations or changes in the costs of provided services. These price adjustments may be applied before or after a booking, but Clients will be notified of any changes in due time. While we make every effort to ensure the accuracy of the information published, itinerary changes or other modifications may occur. Clients should refer to our website for the most current and up-to-date information.
To book your trip aboard the Malaïka Odyssey, please contact us by email, specifying your desired dates and the number of participants.
To secure your spot aboard, a deposit of 50% of the total invoice amount is required. This deposit is non-refundable but can be transferred to another passenger if needed. To secure your reservation, this deposit must be paid within 7 days of booking confirmation. If the deposit is not paid within this period, the reservation may be canceled without prior notice.
The full balance must be paid 90 days before the trip begins. Once the full payment is received, a contract between the Client and MO/PT.MIO will come into effect, confirming the commitment of both parties. From this point, the General Terms and Conditions must be accepted and adhered to.
MO/PT.MIO reserves the right to refuse booking requests and refund the deposit if deemed necessary for operational reasons or others.
The Client is fully responsible for ensuring they have all necessary documents to enter Indonesia, including a valid passport, tourist visa, and appropriate vaccinations.
Indonesian tourist visas obtained on arrival are valid for 30 days and are non-extendable. MO/PT.MIO cannot extend the duration of your visa under any circumstances, and we will not be responsible for any issues related to exceeding the authorized stay period. In the event of an overstay, the Client may face fines or future entry bans to Indonesia.
Tourist visas are issued upon presentation of the required documents upon entry, but it is the Client’s responsibility to check with the Indonesian embassy or consulate for specific procedures depending on their nationality.
The Client acknowledges that participation in adventure activities such as surfing involves inherent risks, including injury, disability, or even death. These risks are amplified by unpredictable environmental conditions and the practice of adventure sports in natural settings.
The Client accepts full responsibility for the risks associated with their participation in activities offered by MO/PT.MIO and agrees to take all necessary precautions to minimize these risks. They are also responsible for their actions and their consequences, whether affecting themselves or others during the trip.
MO/PT.MIO cannot be held responsible for any injury, damage, or loss incurred by the Client or a third party during the trip. The Client agrees to travel at their own risk and understands that all bookings made with MO/PT.MIO are subject to liability limitations imposed by third-party service providers, such as boat operators and surf service providers.
We expect every passenger to adhere to the rules of conduct and safety standards established throughout the trip aboard the Malaïka Odyssey. These rules are put in place not only to ensure the safety and comfort of all passengers but also to maintain harmony aboard and the smooth operation of activities.
Each passenger is required to show respect towards other passengers, the boat crew, and all individuals aboard. This includes, but is not limited to, courteous behavior, respectful communication, and non-aggressive interactions. Disruptive, aggressive, or disrespectful behavior towards staff or other passengers may result in immediate removal from the trip, with no refund.
Alcohol consumption is permitted onboard but must remain within reasonable limits. The Client acknowledges that excessive consumption may lead to dangerous behavior, both for themselves and others, particularly regarding water activities.
Activities offered aboard the Malaïka Odyssey, such as surfing or snorkeling, involve inherent risks. The Client agrees to follow all safety instructions and to comply with the crew’s directions. Anyone wishing to participate in these activities must wear the safety equipment provided by MO/PT.MIO, such as life jackets, and must ensure they possess the required minimum skills.
Clients must also be aware of the specific risks associated with local conditions (ocean currents, waves, marine life, etc.) and must report any health or physical conditions that may affect their ability to participate safely. MO/PT.MIO reserves the right to prohibit participation in any activity if the crew deems a passenger does not meet the minimum safety requirements.
Respect for the environment is crucial during the trip. All passengers must ensure they do not harm marine or terrestrial ecosystems, avoid throwing waste into the sea, disturbing local wildlife, or damaging vegetation. Waste must be kept onboard and disposed of in designated areas.
Additionally, passengers must respect the natural sites visited, following guidelines regarding protected or sensitive areas, and acting with caution and responsibility.
The Client acknowledges and agrees that they are responsible for any damage to property or injury caused, whether to the Malaïka Odyssey, its equipment, or other passengers. In the event of damage caused by negligence or inappropriate behavior, the Client will bear the cost of repair or replacement and may be excluded from the trip. Any situation that endangers the safety of other passengers or the integrity of the vessel may result in immediate exclusion, without compensation.
Failure to comply with the rules of conduct, safety, or other unacceptable behavior may result in immediate exclusion from the trip. In such cases, no refund will be made, and the costs related to the exclusion (early repatriation, fines, etc.) will be borne by the Client.
The onboard team reserves the right to report any infractions to local authorities if they believe safety or legal regulations have been violated.
ndonesia enforces strict drug laws, with severe penalties for possession, trafficking, or use of illegal substances. Possession of drugs, even in small quantities, can result in extended prison sentences and, in some cases, the death penalty. We advise full compliance with local drug laws to avoid serious sanctions.
MO/PT.MIO disclaims all responsibility for illegal behavior by clients, including the consumption or possession of prohibited substances. Any violation of local laws will result in immediate cancellation of the client’s participation in the trip, without refund.
These terms and conditions are governed by Indonesian law. Any dispute regarding the validity, interpretation, or application of these terms, or any dispute related to a trip reservation, will be subject to the exclusive jurisdiction of Indonesian courts. The Client agrees to comply with local laws and resolve any disputes in Indonesia.
